A probation officer for Michael Cummins, 25,  was preparing a warrant for his arrest one day before he was accused of murdering seven people in Westmoreland, Tennessee, on SaturdayA Tennessee man accused of killing seven people was going to be arrested for violating probation the day before the bodies were found, but the probation officer didn't have time to get the warrant signed by a judge, it has emerged.A violation of probation affidavit against 25-year-old Michael Cummins was filed on Monday, two days after he was arrested in connection with the deaths of seven people, including his parents, uncle and a 12-year-old girl, across two crime scenes in the small town of Westmoreland.  The affidavit claims that Cummins failed to undergo a court-ordered mental health evaluation stemming from his conviction for setting a neighbor's home on fire in 2017.   It also stated that he violated a no contact order with that neighbor, whom he assaulted as she was trying to put the fire out.  District Attorney Ray Whitley revealed on Tuesday that Cummins' probation officer had prepared the warrant on Friday but didn't have time to get it signed by a judge. The exact date of the probation violation is unclear.  'Notwithstanding the deaths, he was going to get the probation violation Monday. It was an incidental question of timing,' Whitley said. Authorities have said the murders may have occurred days before the bodies were found.   District Attorney Ray Whitley (above) said Tuesday that Cummins' probation officer had the violation of probation warrant drawn up Friday but didn't have time to get it signed by a judgeCummins was in jail from September 2017 until mid-January of this year in connection with the arson case. He signed a plea agreement last summer under which he was sentenced to 180 days in jail and 10 years probation.  A second affidavit filed against Cummins on Monday accused him of killing his neighbor, Shirley Fehrle, and stealing her car during his crime spree discovered on Saturday.  RELATED ARTICLES

The affidavit states that Fehrle, whose body was found at her home on Luby Brown Road, 'appeared to have blunt force trauma to her face as well as other injuries to her extremities. The remaining six victims were found at a home on Charles Brown Road. He was the only person who was there who didn't die besides my granny.'  The 22-year-old admitted that she knows very little about the shootings that have shattered her family and the small community she grew up in.  'I lost everyone and they won't tell me anything,' she said of investigators.  Despite the lack of information, Crystal said: 'Truly in my heart I believe he had something to do with it.'I can't imagine my brother doing that to his own family. He had to have.'She said she sensed something was wrong last week after she hadn't heard from her parents, David, 51, and Clara, 44, for a couple days.'I called my mom on Thursday, no answer, called by granny, no answer, called my dad, no answer, called my uncle Charlie, no answer. I thought maybe they were sick so I stopped calling,' she said. When Saturday rolled around and they still weren't answering, one of Clara's sister's went over to the house where they all lived on Charles Brown Road. She forced open the locked door and discovered the first of six bodies that would eventually be found inside the house.  A has been set up for funeral expenses for Marsha, Rachel and Sapphire which has raised more than $1,200 so far.    Brian Cummins said of his nephew Michael Cummins: 'I love him to death, but when he killed my brother and them, I wish I would've killed him that night'Brian Cummins, whose brother David was killed, told that he wishes he had taken justice into his own hands on Saturday night before Michael's arrest.  'I love him to death, but when he killed my brother and them, I wish I would've killed him that night.' According to court documents, Brian saw Michael on Saturday evening wearing a white t-shirt stained with blood. The suspect allegedly claimed that the stains were chocolate.  'I said no it ain't.
